The standing order did not arrive on the first. You gave it a few days, because it has happened before and it was the bank. On the eleventh you sent a polite text and got nothing back. On the fourteenth you rang and it went to voicemail.
Everything you do from here is a bet on which of two situations this is: a tenant who has had a bad month and is embarrassed, or a tenant who is leaving and has decided you are the creditor who can wait.
Talking is not softness, it is the cheapest available option
Serving notice feels decisive. It is also the point at which a tenant who was going to fix this stops talking to you, because they now have a legal problem and will be told, correctly, to take advice.
Before that, find out what has happened. A job lost, a relationship ended, a benefit claim changed, hours cut. Most arrears in this country start with one of about six events, and most of them are temporary. A tenant who has just moved onto Universal Credit is not refusing to pay, they are waiting, because the standard first assessment period plus the payment run means a five-week gap between claiming and the first payment landing.
Where the cause is temporary, a written payment plan is worth more than a notice. Set out the arrears figure, the rent, the extra amount per month, the date each payment is due and the date the arrears clear. Get it agreed by email. It gives you a record, it gives the tenant a finish line, and if it fails, you have evidence of reasonableness that a judge will read.
Two things to know about the wider landscape. A tenant in serious debt can apply for a moratorium under the Debt Respite Scheme, introduced by the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020. Standard breathing space lasts 60 days, during which you cannot take enforcement action or charge interest on the qualifying debt. It is not a trick, it is a debt adviser doing their job, and it is usually a sign the tenant is engaging with the problem.
Universal credit can be redirected, but you have to ask
Where a tenant receives the housing element of Universal Credit, the default is that it is paid to them. An Alternative Payment Arrangement can redirect the housing element straight to you as a managed payment, and a separate third party deduction can take an amount towards the arrears on top.
A landlord can apply using form UC47. Broadly, a managed payment is considered where the tenant is in arrears of two months or more, and it becomes the expected route where arrears reach that level, though the Department for Work and Pensions retains discretion and will also consider tenant vulnerability. Deductions for rent arrears are taken as a percentage of the standard allowance and are capped, so they clear arrears slowly rather than at once.
Landlords routinely do not apply because they assume it is only for social housing. It is not. It will not solve arrears built up over a year, but it stops them growing while you decide what to do, and a tenant who is on benefits and in arrears is usually the tenant most worth keeping in the property rather than replacing.
Two months is the number the law cares about
Possession for arrears runs under section 8 of the Housing Act 1988 and the grounds in Schedule 2. Ground 8 is the mandatory one: for a monthly tenancy, at least two months' rent unpaid both at the date the notice is served and at the date of the hearing. If the tenant pays a penny below that threshold the morning of the hearing, ground 8 goes.
Grounds 10 and 11 are discretionary. Ground 10 is some rent lawfully due. Ground 11 is persistent delay in paying, which catches the tenant who always pays but never on time. Discretionary means the judge decides whether it is reasonable to make an order, and can make a suspended order instead, which keeps the tenant in the property on terms.
Serve on all three grounds. There is no cost to doing so and a claim resting on ground 8 alone dies the moment the arrears dip.
The timetable is the part people underestimate. Notice period, then issue the claim, then wait for a hearing date, then, if the tenant does not leave, apply for a warrant and wait for a county court bailiff, or transfer up to the High Court for enforcement. Between the first missed payment and vacant possession, six months is a good outcome and longer is common. Throughout it, the rent is not being paid, and the mortgage is.
Possession in England is being reshaped by the Renters' Rights Act 2025, including changes to the arrears grounds and notice periods, and commencement is staged. Check where it has actually got to before you serve anything, because a notice on the wrong form is a wasted notice.
The arithmetic decides, not the principle
Once you are past three months, stop thinking about whether it is fair and start counting.
- The cost of pursuing: court fee to issue a possession claim, plus a hearing fee if it is listed, plus solicitor or agent costs which are usually not recoverable in full, plus a bailiff or High Court enforcement fee, plus the rent you do not collect during the process.
- The cost of ending it now: a negotiated surrender, perhaps with arrears written off and sometimes with a contribution towards their moving costs, plus a void of a few weeks and a re-let fee.
The second is frequently cheaper, which feels wrong and usually is not. A money judgment against someone with no money is a piece of paper. The value in a possession claim is the property back, and if you can get the property back without the claim, you have bought the same thing at a discount.
What you should do in every case is keep the rent account. A simple statement of the rent due, the date, the amount received and the running balance, updated monthly. It costs nothing, it is the first document the court will want, and it is the difference between a hearing that takes fifteen minutes and one that gets adjourned.
Where this shows up in the game
Letting property arrives in Business Baron with the Property & Construction Track, an add-on to the full game. Customers in the game have payment behaviour rather than instant settlement, and a business that never chases quietly funds everybody else. The decision in front of you is usually whether to spend money chasing money, and the monthly figures make the answer plain.
